What is an SBR Practitioner?
A Small Business Restructuring Practitioner (SBRP) is a registered professional appointed under Part 5.3B of the Corporations Act 2001. Their role is to
Assess the company’s eligibility for restructuring
Assist in preparing a Small Business Restructuring Plan for creditor consideration
Oversee the process and ensure it complies with legal requirements
Act as an independent point of contact for creditors during the plan period
During SBR, the appointed practitioner does not take control of the company. This remains with directors. However, directors must work cooperatively with the practitioner in order to meet their statutory obligations.
HLB Mann Judd's Role as Your Small Business Restructuring Practitioner
Our approach is focused on clear communication, prompt action and practical solutions that are tailored to your business. Our registered SBR practitioners can assist with:
Determining SBR eligibility based on your current financial position
Preparing accurate declarations, supporting documents and forecasts
Engaging creditors and managing questions or objections
Ensuring timelines and compliance obligations are met
Monitoring progress and advising throughout the plan period
Providing SBR training to your staff and advisors
We understand the importance of preserving relationships and operational efficiency during periods of financial uncertainty. To support that, we promote a transparent, efficient process that gives your business the best chance of recovery.
Advisory Support for Businesses and Accountants
In addition to acting as appointed practitioners, we also work with business owners and their advisors (such as accountants, bookkeepers and legal counsel) to offer independent, confidential advisory support. This can be helpful if:
You’re preparing to enter the SBR process but have not yet appointed a practitioner
You want to assess the viability of a small business restructure before making a formal decision
You need guidance on documentation, timing or creditor engagement
You’re an accountant supporting a client through restructuring and need clarity on the process
We recognise that every business, and every restructure, is different. Our staff will tailor their involvement to your needs – whether that’s acting as an advisor or stepping in as the appointed practitioner when the time is right.

FAQs
No. One of the key features of Small Business Restructuring is that directors remain in control of day-to-day operations throughout the process. Rather than running the business, the role of the practitioner is to guide the process, assist in preparing the restructuring plan and ensure compliance
A restructuring practitioner works with a business that is seeking to continue trading by restructuring its debts. A liquidator, on the other hand, is appointed to facilitate the dissolution of company that is no longer viable. The goals, powers and outcomes of these roles are fundamentally different.
Only a registered practitioner authorised by ASIC can act in this role. While your accountant may be closely involved in preparing documentation or financial records, the formal position must be held by a person qualified and licensed as an SBR practitioner. At HLB Mann Judd, we have several licensed practitioners in our team, all ready to assist your business.
