What is an SBR Practitioner?

A Small Business Restructuring Practitioner (SBRP) is a registered professional appointed under Part 5.3B of the Corporations Act 2001. Their role is to

  • Assess the company’s eligibility for restructuring

  • Assist in preparing a Small Business Restructuring Plan for creditor consideration

  • Oversee the process and ensure it complies with legal requirements

  • Act as an independent point of contact for creditors during the plan period

During SBR, the appointed practitioner does not take control of the company. This remains with directors. However, directors must work cooperatively with the practitioner in order to meet their statutory obligations.

A restructuring practitioner works with a business that is seeking to continue trading by restructuring its debts. A liquidator, on the other hand, is appointed to facilitate the dissolution of company that is no longer viable. The goals, powers and outcomes of these roles are fundamentally different.

Only a registered practitioner authorised by ASIC can act in this role. While your accountant may be closely involved in preparing documentation or financial records, the formal position must be held by a person qualified and licensed as an SBR practitioner.
